South DakotaConstitutional Amendment J

Constitutional Amendment J

South Dakota · November 3, 2026

Provide that "[an] individual who is not a citizen of the United States is disqualified from voting in any election or upon any question submitted to the voters"

A yes vote means Non-citizens would be explicitly banned from voting in state and local elections through the state constitution.
A no vote means The state constitution would remain unchanged, and voting rules would continue to be governed by existing state and federal laws.
Simple explanation
This amendment would add a rule to the state constitution saying that only U.S. citizens can vote in elections. It's basically writing into the constitution something that's already federal law, making it extra clear at the state level.
